Managua, Costa Rica, Washington D.C. November 30, 2022.- The Nicaraguan Center for Human Rights (CENIDH), the Nicaraguan Nunca Más Human Rights Collective, the Legal Defense Unit (UDJ), the Registration Unit (UDR), the Nicaraguan Initiative for Women Rights Defenders Human Rights (INDDHH), CEJIL, Raza e Igualdad, and relatives of persons deprived of liberty for political reasons, celebrate the requirements of the Inter-American Court of Human Rights to the State of Nicaragua established in its Resolution notified on November 29, to whom it once again demands that the immediately to the 76 people who are beneficiaries of the Provisional Measures in the matters of Juan Sebastián Chamorro and others (31 people); and 45 people deprived of their liberty in 8 detention centers with respect to Nicaragua. All for political reasons.
On November 9, the Inter-American Court of Human Rights (IACHR) held a public hearing to analyze the non-compliance with both Provisional Measures. There, the signatory organizations demanded that the release of persons deprived of liberty for political reasons in Nicaragua be ordered. Despite the seriousness of the situation, the State did not appear in court.
In its resolution, the Inter-American Court declared the State of Nicaragua in “permanent contempt” after having issued 6 resolutions in the framework of the provisional measures granted in favor of Juan Sebastián Chamorro and 45 other people deprived of liberty for political reasons, denouncing that the orders issued by the Court have been systematically neglected by the government of Daniel Ortega. In the words of the highest court on human rights in our region, this is “contrary to the international principle of complying with its treaty obligations in good faith and a breach of the duty to inform the Court.”
Consequently, in an unprecedented resolution, the Inter-American Court instructed its President, Judge Ricardo Pérez Manrique, to present to the Permanent Council of the Organization of American States (OAS), a report that includes both the situation of contempt of the State of Nicaragua as the “absolute lack of protection” in which the beneficiaries of both provisional measures find themselves.
Likewise, the Court determined “to urge the Permanent Council of the OAS so that, in application of the collective guarantee, it follow up on the non-compliance with these Provisional Measures and the situation of the persons identified in operative paragraph 6 and demand that the State compliance with what is ordered by this Court” indicates point 4 of the Court’s resolution.
For this reason, the Court expresses its concern at the fact that the 76 beneficiaries remain detained, “with the exception of one of the beneficiaries who left the country, despite the fact that the Court has requested her immediate release on several occasions. In addition, their regular contact with relatives and lawyers has not been facilitated and they have not been guaranteed access to health services and medicines, nor to adequate food. Added to the foregoing is the information provided by the representatives, referring to the conditions of detention”, is expressed among the conclusions of the Court.

The accompanying organizations and representatives of the beneficiaries and their families recognize the forceful statements of the Honorable Inter-American Court and demand that the State of Nicaragua immediately comply with what has been ordered, proceed to the immediate unconditional release and with guarantees, protect their personal integrity, act in good faith in accordance with their international obligations and comply with the provisional measures aimed at guaranteeing the life and physical integrity of the beneficiaries.
